Terms of service

1. Agreement

By accessing or using SMIKE TRADING LIMITED (website, portals, or related services), you agree to these terms and our privacy policy. If you do not agree, do not use the service.

2. The service

SMIKE TRADING LIMITED provides software tools for vehicle listing, customer onboarding, hire-purchase / cash / instalment contracts, payment recording, documents, and related operations. We are a technology platform operator; individual finance offers and credit decisions are made under the terms of each contract and applicable law.

3. Accounts

• You must provide accurate registration and KYC information.
• You are responsible for safeguarding login credentials and activity under your account.
• Some features remain limited until an account is approved by authorised staff.
• We may suspend or terminate accounts for fraud, abuse, or legal risk.

4. Contracts and payments

• Hire-purchase, cash-sale, and instalment terms are set out in the signed agreement and schedules in the system.
• Payment methods (e.g. M-Pesa, bank transfer, cash, cheque) may have limits, clearing times, and provider rules outside our control.
• Receipts and statements generated by the system are tools for transparency; the governing legal instrument remains the signed agreement and applicable law.
• Late payment, penalties, and default are handled per the contract and internal collections processes.

5. Vehicles and dealers

Vehicle availability, condition, and pricing may change. Listings on the browse pages are informational. Dealer and staff users must only enter accurate stock and customer data.

6. Acceptable use

You must not misuse the platform (including unauthorised access, scraping, introducing malware, impersonation, or using the service for unlawful activity). We may investigate and take technical or legal action.

7. Intellectual property

Software, branding, templates, and content on SMIKE TRADING LIMITED are owned by the operator or licensors. You receive a limited right to use the portals for authorised business purposes only.

8. Disclaimers

The service is provided on an “as available” basis. We do not guarantee uninterrupted operation or that third-party payment networks will always succeed. To the extent permitted by law, liability for indirect or consequential loss is excluded.

9. Liability

Nothing in these terms limits liability that cannot be limited under Kenyan law (including fraud or personal injury caused by negligence). For other claims, our aggregate liability related to the software service is limited to fees paid for the service in the three months preceding the claim, if any.

10. Governing law

These terms are governed by the laws of Kenya. Courts in Kenya have exclusive jurisdiction, subject to mandatory consumer protections.
